If a notice arrives

A city-parish order on a car in your yard, step by step

  • Note the day it reached you. The order comes in writing, handed to you or sent by certified mail. It names the problem, where the car sits and what has to be done, and you have 15 days from that day to comply. Refusing the certified letter doesn't stop the clock; the 15 days start on the day you refuse it.
  • Disagree? Ask for a hearing within 7 days. The written request has to reach the enforcing agency within seven days. Otherwise, use the 15 days to remove the car or start repairs, and finish the repairs within 30 days. The agency can allow up to six months for repairs when there's good cause.
  • Report that it's gone. The code makes it your job to tell the agency once the car is removed or fixed, and the agency then sets an appointment to check. After a sale, give them the pickup date. Miss the deadline without asking for a hearing, and the agency can issue a misdemeanor summons, with a fine of up to $500, and have the car towed.

East Baton Rouge Parish is the center of the pickup area, from downtown (70801) out to Central, Baker, Zachary and St. George, which became its own city in 2019. It also crosses into the next parishes: Port Allen (70767) in West Baton Rouge, Denham Springs (70726) and Walker in Livingston, and Prairieville and Gonzales in Ascension. Car parked in St. George? The city runs its own code enforcement department, with five officers, one for each district, and its list of common violations includes storing or parking inoperable or dismantled vehicles. A complaint is checked the same day or by the next business day, and if the officer finds a violation, the notice goes out by certified mail within 24 hours of the inspection. On a Baton Rouge street, a car without current registration already counts as inoperative under the city-parish chapter on public property. In a driveway or yard it doesn't. There, the private-property chapter says an expired registration, inspection sticker or plate isn't enough on its own. A car is inoperative when it can't lawfully be driven on the streets, and wrecked or dismantled cars count. Outside a few exceptions (see the questions below), such a car on private property is declared a public nuisance.

A car that took water and no longer runs fits that definition. The August 2016 flood brought record flooding to the Amite and Comite river basins, and the widest damage was in East Baton Rouge, Livingston, Ascension and Tangipahoa parishes, per the National Weather Service. Can I get cash for a junk car in Baton Rouge that's parked on the street?

Yes, but don't leave it there long. Under the city-parish code for public property, a car left unattended and inoperative for 48 hours counts as abandoned. The enforcing agency can then have it towed to an approved wrecker, and the owner owes the towing and service fees.

Is the OMV on Independence Boulevard the only place to transfer a title in Baton Rouge?

No. Your buyer can use a Louisiana OMV (the state's DMV) office or a public tag agent. The OMV office at 7701 Independence Boulevard keeps weekday hours of 8 a.m. to 4 p.m. and works by appointment, booked on ExpressLane. The City-Parish government runs its own public tag agent at 233 St. Louis Street, open weekdays 8:30 a.m. to 3 p.m., and the OMV's office list shows 21 more in the parish. Can I keep a project car in my Baton Rouge driveway?

In some cases. The city-parish's private-property rules don't apply to a car kept completely inside a building where it can't be seen from the street or other property. They also exempt an antique kept for collecting, which the code defines as a working car 25 years or older, mostly original, registered as an antique with antique plates. A car stored by a member of the armed forces on active duty is exempt too. A car that fits none of those and can't be driven legally falls under the notice steps below.

Is there an OMV office outside the city, closer to Port Allen, Gonzales or Denham Springs?

Yes. The OMV runs field offices at 782 Louisiana Avenue in Port Allen, 320 East Ascension Street in Gonzales and 20355 Government Boulevard in Livingston, each listed as open weekdays from 8 a.m. to 4 p.m. The OMV's list also shows public tag agents in Denham Springs, Walker and Prairieville.
