Paperwork

The paperwork, in plain terms

Paperwork stalls more car sales than condition does. Almost none of these problems are dealbreakers, they are just unfamiliar. Here is what each one actually is.

The title

The title proves you own the vehicle, and the name printed on it has to match the person signing it over. Look at yours before you do anything else and check two things: whose name is on it, and whether a lienholder is listed.

If a lienholder is listed

That means a bank or credit union financed the car and has a legal claim on it. If the loan is paid off, the lender issues a lien release, and the sale proceeds normally. If it is not paid off, the loan gets settled out of the sale before you receive anything. Either way it is routine, and buyers deal with it constantly.

If you cannot find the title

Very common, and solvable. Your state motor vehicle agency issues duplicate titles to the registered owner, usually through a short application and a fee. Some buyers also purchase vehicles without a title in certain states and situations, with additional documentation. Rules vary meaningfully by state, so this is a question worth asking directly rather than assuming.

If the owner has died

An inherited vehicle transfers through the estate, and what you need depends on your state and whether the estate went through probate. Many states have a simplified process for transferring a vehicle to a surviving spouse or heir without full probate. Bring what you have and expect a couple of extra forms.

Before you hand over the keys: remove the license plates unless your state instructs otherwise, take your personal items out including anything in the trunk and glovebox, and notify your insurer and your state agency that the vehicle was sold. That last step is what protects you from tickets and liability after the car leaves.

Expired registration

Not an obstacle. Registration is about operating the vehicle on public roads, ownership is what the title records. A car that has not been registered in years can still be sold.
