How to fill out New Mexico MVD-10022

For the document that never came. Three checkboxes name what went missing - a registration with sticker, a cab card with sticker, or the Certificate of Title - and the affidavit certifies that you applied and paid for the item, did not receive it, and still live at the address it was sent to. Where the division mailed a title to a wrong address through its own clerical error, the manual pairs this affidavit with a no-fee replacement; where the address was right and the mail simply failed, the duplicate-title route and its fee take over.

Two documents, and they are not the same thing. Take the blank MVD-10022 from the realfile.tax.newmexico.gov copy so you get the revision that is current today, then print our MVD-10022 guide and keep it beside you while you fill theirs in.

Written against MVD-10022 (Rev 12/90), issued under Vehicle Procedures Manual, Chapter 8 Section O (Re-Issuance of Title after Non-Receipt). A seller most often meets this form one step removed: you apply to title or the buyer applies, weeks pass, and no certificate lands. Check the address on the record before swearing anything - the affidavit certifies the address has not changed, and the commonest reason mail fails is that it has.

Watch out: That third clause is the trap. If you moved between applying and swearing, stop - file the address change and take the duplicate route instead of certifying something false.

Watch out: If the division's own error misdirected the title - wrong address by clerk mistake, inside the manual's 30-and-90-day windows - the replacement is free. Say so plainly; the clerk can see the mailing history.

What gets this one rejected

•More than one box checked. The affidavit covers the item indicated - one affidavit, one missing document.
•An address that has changed. The certification's last clause is that your address has not changed; if it has, this affidavit is the wrong instrument and the address change comes first.
•No proof of payment behind a check claim. The form asks for the cancelled check, both sides - the affidavit certifies you paid, and the copy is what makes that checkable.
•Filed for a title the record shows was never issued. Non-receipt presumes the division sent something; a title never applied for is a transfer, not a replacement.
•Used outside its windows for the no-fee route. The manual's free reissue requires at least 30 days since issuance and a request within 90 days of it - outside those, the ordinary duplicate fee applies.
•Sworn loosely. Like every New Mexico motor-vehicle affidavit, a false statement here sits under the fourth-degree-felony perjury statutes.

Rules that decide whether it is accepted

•The no-fee replacement is narrow and real. All of: the division mailed the title, the address on record was wrong by clerk error, 30 days have passed since issuance, and the request comes within 90 days. Meet all four and the replacement costs nothing.
•By mail, enclose the licence. The manual's instruction for mail applications is a photocopy of the driver's licence with the affidavit.
