How to fill out Nevada VP 249, the Affidavit of Acknowledgement for a Power of Attorney

The agent on a power of attorney swearing that the copy being handed over is genuine, that the person who granted it is alive, and that the powers have not been altered or revoked. It travels with VP 136 rather than replacing it.

Written against VP 249 (2/2023), issued under NRS Chapter 13. February 2023 revision. Nevada Revised Statute Chapter 13 gives a third party the right to demand this, which is why it appears without warning at a counter. The person completing it must be the agent named on the power of attorney — nobody else can swear to it.

Two documents, and they are not the same thing. Take the blank VP 249 from the dmv.nv.gov copy so you get the revision that is current today, then print our VP 249 guide and keep it beside you while you fill theirs in.

Every line, in the order you meet it

    You fill this in

    Name of agent on the power of attorney

    You, if you are the one holding the power.

    Watch out: It has to match the attorney in fact named on the VP 136 exactly. Two versions of the same name across the two documents is the failure here.

    You fill this in

    Name of principal on the power of attorney

    The person who granted you the authority.

    Watch out: As the power of attorney spells it, which should in turn match the title. All three documents are being read together.

    Vehicle Identification Number

    One character per box.

    Watch out: The vehicle the power is being exercised over. A power of attorney written against one car cannot carry a second one.

    Affiant's printed full legal name

    Your name again, printed.

    Watch out: Same person as the agent above. It repeats because this is the sworn statement rather than the description.

    Licence number, date of birth or FEIN

    Nevada driver's licence or identification card number.

    Watch out: Yours as agent. The principal's identification belongs on the power of attorney, not here.

    Physical address

    Where you live.

    Watch out: Your address, not the principal's, even when you are acting entirely on their behalf.

    Watch out: "Same as physical" when they match, so the block reads as answered rather than skipped.
