How to fill out Kansas TR-40

The second half of the electronic-title sale: a power of attorney that appoints the buyer as the seller's attorney-in-fact to apply for title, endorse and transfer it, and disclose the mileage exactly as stated in the disclosure the seller makes on this same sheet. It exists because the paper certificate arrives weeks after the handshake - the sworn price and odometer statements happen now, on this form, and the buyer completes the assignment alone when the clear title prints. Its instructions confine it to a sale by the owner to an individual or business that is not a licensed dealer - what the form calls an isolated or occasional sale.

Written against TR-40 (Rev 06/21), issued under K.S.A. 8-135d and 49 CFR Part 580. This sheet moves real authority - full authority to apply for, endorse and transfer title - to a person you may have met an hour ago. It is the right tool when the same sheet also fixes the price and the mileage in sworn ink, because the buyer can only complete the assignment with the numbers you certified. Fill in every blank before signing, because an incomplete power of attorney is a blank cheque with your name on it.

Two documents, and they are not the same thing. Take the blank TR-40 from the ksrevenue.gov copy so you get the revision that is current today, then print our TR-40 guide and keep it beside you while you fill theirs in.

Every line, in the order you meet it

   You fill this in

   The vehicle

   Year, make, style and VIN.

   Watch out: Copy the VIN from the registration receipt you attached to the TR-39a - it is the same record the Division will print the paper title from.

   You fill this in

   The appointment and its date

   Your printed name, the buyer's printed name as attorney-in-fact, and the date of this statement.

   Watch out: Date it the day of the sale. The disclosure's validity and the appointment's scope both hang on this being the mileage as of the transfer.

   The odometer reading

   The miles now showing, in the blank the certification sentence wraps around.

   Watch out: The form prints .0 after the blank - whole miles only. If the reading needs a statement, tick exactly one; if it does not, tick neither and the printed sentence certifies it as actual.

   The sworn price

   The purchase price, inside the perjury sentence.

   Watch out: This figure must agree with the TR-39a and, eventually, the assignment the buyer completes - it is the number the county taxes, and the appointment only authorises the buyer to write what you swore.

   Watch out: Original ink, all three lines. The Division rejects faxed and photocopied powers of attorney outright, so the physical sheet - not a scan - is what the buyer carries to the treasurer's counter with the title.

   Their signature under the acknowledgement sentence, hand printed name, and address.

   Watch out: Their signature acknowledges your odometer certification and swears the price - the same two acknowledgements the statute builds into a paper assignment, relocated to the sheet that exists before the paper does.

What gets this one rejected

• •Using it on a dealer sale. The instruction confines this form to a vehicle sold by the owner to an individual or business that is not a licensed dealer - the dealer version of this transaction runs on secure dealer stock instead.
• •Using it when a paper title is sitting in a drawer. The form is for vehicles whose title the State of Kansas holds in electronic form; a paper certificate in hand takes an ordinary assignment, or a TR-41 if someone must sign for you.
• •A photocopy or fax. The Division's power-of-attorney rule is original ink, and a copy of this sheet appoints nobody.
• •Leaving the price or mileage blank for later. Both certifications are sworn on this sheet now, under penalty of perjury - later is exactly what the form exists to remove.
• •Ticking a mileage statement that is not true. The not-actual statement carries the printed warning odometer discrepancy, and it brands every title the vehicle is issued afterwards.

Rules that decide whether it is accepted

• •It survives the wait for the paper title. The appointment covers endorsing and transferring the title when it arrives, so the buyer finishes the assignment without a second meeting - the disclosure they write is the one you swore here.
• •The 2011 line is printed on the sheet. The notice to an out-of-state buyer carries the age rule in the Division's own words: model year 2011 and newer require disclosure for 20 years.
• •One person still cannot sign both sides. This form works because seller and buyer each sign their own half. The only instrument that lets a single person sign for both in a disclosure-age sale is the secure power of attorney from a licensed dealer's stock.
