Where the claiming-successor affidavit turns on the estate's size, this certificate turns on who you are: the signer certifies as heir or spouse that the vehicle was not devised by will to anyone else, that no personal-representative appointment is pending or granted anywhere, that thirty days have passed since the death, and that they are entitled to the vehicle by operation of law. Same one-page shape, same notarization, same four-box odometer disclosure - different oath.

Divorce and death interact with plates in a way this paperwork does not spell out: a plate is yours only if your name was already on the title as an owner. An heir who inherits a vehicle inherits the vehicle - the plate-to-owner rule still runs its own course, and special plates carry their own qualification requirements to whoever keeps them.

What gets this one rejected
•A claimant who is neither spouse nor legal heir. This certificate's entitlement is by operation of law - a friend, a caretaker or a creditor uses the claiming-successor route or a court order, not this page.
•A will that gives the vehicle to someone else. The first sworn condition excludes exactly that case; a devised vehicle follows the will through the personal representative.
•An out-of-state version of the same idea. The manual is firm that a transfer without probate from out of state cannot be accepted - the process runs only in the jurisdiction where the vehicle was titled.
•No death certificate presented. The original or certified copy - or the military DD-1300 casualty report - must be shown, and the clerk affirms on the retained copy that they saw it.
•Sworn before the thirty days have run. The waiting period is a condition of the certificate, not a formality around it.
•A lien ignored because the borrower died. The release requirement survives the owner; the lender releases, or the lien rides onto the next title.
Rules that decide whether it is accepted
•Lost titles are survivable here too. The heir or spouse may apply for a duplicate title, and the clerk processes it as a title transfer - the same accommodation the successor route gets.
•The tax follows consideration, not death. A transfer to an heir for nothing carries no excise tax; the registration and title fees still apply, and any later sale by the heir is taxed like any sale.
