How to fill out Arkansas 82

The paperwork for selling a car as scrap, and the filing that ends a title forever. Its instructions carry the whole rule: any owner who sells a motor vehicle as scrap or to be dismantled or destroyed must assign the certificate of title to the purchaser, and the assigned certificate is delivered to the Office of Motor Vehicle accompanied by this notice. The office cancels the certificate and records the vehicle as dismantled, after which a certificate of title shall not be issued again - the only exit is certifying within ninety days that the notice was filed in error. A vehicle at least twenty-five years old with no certificate available may travel on a bill of sale instead, and after cancellation the vehicle itself moves by endorsement on a bill of sale carrying the form's three required elements.

Filed by you, this notice is also your release: once the office records the vehicle as dismantled, the state's file shows the car left the road in your hands on a stated date - worth more than the scrap cheque if the shell ever turns up somewhere it should not be. File it yourself rather than trusting the yard to.

   Assign the title to the scrap buyer first

   The ordinary Arkansas assignment on the certificate's back, to the yard or dismantler purchasing - the notice accompanies the assigned title, it does not replace the assignment.

   Watch out: Twenty-five years old or more with no certificate available? The exception lets a bill of sale carrying year, make, model and VIN stand in.

   Your name and address

   Printed name of the party submitting notice, with a mailing address.

   Watch out: Whoever files owns the ninety-day error window - only the party filing the notice can certify a mistake. Filing it yourself keeps that key in your pocket.

   Year, make, model, VIN, title number and date for each vehicle being scrapped.

   Watch out: The title number comes off the certificate you just assigned. Copy it before handing the paper over, not after.

   Your signature at the foot, then the notice and the assigned certificate go together to the Office of Motor Vehicle, Records Unit, P.O. Box 1272, Little Rock.

   Watch out: Keep copies of both and of the yard's payment. Dated together, they are the complete story of the vehicle's last day as yours.

   Understand what the record now says

   The certificate is cancelled and the vehicle is recorded as dismantled - it can be possessed, transported or transferred afterwards only by endorsement on a bill of sale carrying the identifiers, the no-future-title statement, and both signatures with the date.

   Watch out: Give the yard a copy of the notice with the bill of sale wording it needs. A dismantler who paperworks the hulk properly is a dismantler who never causes you a phone call.

What gets this one rejected

• •Skipping the title assignment. The owner must assign the certificate of title thereto to the purchaser even though the vehicle is going to a crusher - scrap sales are still sales.
• •Filing it about a vehicle you might restore. Cancellation is permanent: no certificate of title shall be issued again for a vehicle recorded as dismantled, and the ninety-day error window requires certifying the filing itself was a mistake.
• •A twenty-five-year-old-vehicle bill of sale without the identifiers. Where the old-vehicle exception applies, the bill of sale stands in for the title only if it identifies the vehicle by year, make, model, and vehicle identification number.
• •Moving the dismantled vehicle on nothing. After cancellation, possession and transfer run on a bill of sale that must reflect the vehicle's identifiers, a statement that notice has been forwarded and no title will again issue, and the signatures of buyer and seller with the date of sale.
• •Guessing the title number. The table asks for it per vehicle, and the Records Unit is cancelling a specific certificate - the number is on its face.

Rules that decide whether it is accepted

• •Ninety days to change your mind, and only for error. A certificate can issue again only upon certification within ninety days of the filing, from the party filing the notice, that the notice of intent to dismantle was filed in error - regret is not error.
• •The parts-only title is the other road. A wrecked vehicle worth keeping as a parts donor can instead take a PARTS ONLY title, which keeps a certificate in existence - permanently branded - rather than cancelling the record outright.
