How to fill out South Dakota Form 1402

Form 1402 is filed by a licensed dealer, and only by the small number of dealers the department has authorised to opt out of its online system: the instruction reads that dealers authorized by the Motor Vehicle Division to opt out of the online computer system must file this form, along with a $5 service fee, with the new purchaser's county treasurer within 15 days of the date of sale of the vehicle. A private seller who files this has filed nothing that satisfies SDCL 32-5-2.10.

This form is not shown filled in because it is not a document a private seller may complete: every version of it carries a dealership name and a Dealer License Number issued by the Motor Vehicle Division, and filling those in with invented details would model an offence rather than a transaction. What gets this one rejected

•A private seller's name in the dealership block. There is no licence number to put beside it, and the form is scored against the dealer licensing rules rather than against the seller's statute.
•Filing it more than fifteen days after the sale. The form's own sentence makes that a dealer violation, which is a licensing matter and not a fee.
•Sending it without the $5 service fee, which the instruction names alongside the form.
•Filing it at all as a dealer who did not opt out. A sale by a dealer inside the online system creates a pending title record, and the manual says that replaces any need for a report of sale form.
•Filing it with the seller's county treasurer. It goes to the new purchaser's county treasurer, which is where the title application will land.

Rules that decide whether it is accepted

•Whose form it is, in one line. Only a dealer the Motor Vehicle Division has authorised to opt out of the online computer system files this. Everyone else in a dealer transaction is covered by the pending title record.
•Fifteen days, not forty-five. The dealer's clock on this form is fifteen days from the date of sale. The private seller's report under s. 32-5-2.10 has no days at all - it is due at the time of sale.
•What a private seller files instead. Form 1024, the tear-off strip at the foot of a recent certificate, or a report of sale through the state's vehicle portal.
•It carries no odometer entry. Unlike the seller's report, this form has no mileage block. The dealer's odometer duty is discharged in the assignment or on a secure reassignment form.
