How South Carolina handles a lapse

South Carolina does not stack, on either half of the bill. The SCDMV delinquency penalty is a four-step ladder that tops out at $75 once the owner is more than ninety days late - the same $75 whether the lapse is four months or thirty years, and it is charged once, not once per lapsed year. The county property tax cannot pile up either, because SC Code 12-37-2610 pins the vehicle's tax year to its registration period and requires the tax to be paid 'for the year for which the registration is to be issued' - forward-looking, so periods with no registration generate no vehicle tax year and no bill. What the owner owes is one biennial registration fee, one $75 penalty, and one prospective county tax bill. Registration is state (SCDMV); the property tax is assessed and billed by the county auditor and collected by the county treasurer.

The owner of every vehicle required to be registered and licensed under the provisions of this chapter who fails to register and license the vehicle and pay the specified fees or renewal, when and as required, upon registering the vehicle shall pay to the Department of Motor Vehicles a delinquency penalty fee of ten dollars, if the owner is delinquent less than fifteen days. If the owner is delinquent by fifteen days but less than thirty days, he shall pay a delinquency penalty of twenty-five dollars. If the owner is delinquent by more than thirty days but less than ninety days, he shall pay a delinquency penalty fee of fifty dollars to the department. If the owner is delinquent by more than ninety days, he shall pay a delinquency penalty fee of seventy-five dollars to the department.

If you sell it instead

Whoever registers. The property tax must be cleared before SCDMV will issue the registration, so the charge attaches to the transaction rather than following a former owner.

Ways the state forgives a lapse

Prospective only, and narrow: SC Code 56-3-900(A) refunds the full biennial registration fee where the vehicle 'has not been operated in this State or elsewhere as a vehicle registered and licensed under the laws of this State since the beginning of the registration and license period', if the claim is filed within ninety days of registering, is supported by evidence of nonoperation satisfactory to SCDMV, and is accompanied by the returned card and plates. There is no after-the-fact non-use affidavit that wipes out a lapse, and none is needed - the lapse itself generates no back charges.
